Distance Sales Agreement

ARTICLE 1 – PARTIES AND SUBJECT

This Distance Sales Agreement (“the Agreement”) has been concluded electronically between the BUYER and the SELLER under the terms and conditions specified below. The BUYER and the SELLER shall hereinafter be referred to collectively as “the Parties” and individually as “the Party”.

ARTICLE 1.3 – SUBJECT

The subject of this Agreement is to determine the rights and obligations of the Parties in relation to the sale and delivery of the product or service, whose characteristics and sales price are specified, ordered electronically by the BUYER from the SELLER’s website www.sezaibey.com, in accordance with the provisions of the Law on Consumer Protection No. 6502 and the Regulation on Distance Contracts.

ARTICLE 3 – PRODUCT SUBJECT TO ORDER

The type, kind, quantity, sales price, and payment information of the product subject to the order are included in the order summary and pre-information form.

VAT is included in the product price.

ARTICLE 4 – MATTERS THE BUYER WAS INFORMED OF IN ADVANCE

The BUYER acknowledges that they have been accurately and completely informed about the basic characteristics of the product, sales price, payment method, delivery conditions, right of withdrawal, and return conditions before placing an order.

ARTICLE 5 – PAYMENT TERMS

5.1- Payment can be made by credit card, bank transfer, or EFT.

5.2- The order will not be processed until the product price is fully paid.

5.3- For bank transfer or EFT payments, the order will be canceled if not paid within 3 business days.

ARTICLE 6 – DELIVERY

6.1- The product subject to the order will be delivered to the address provided by the BUYER within 30 days at the latest from the order date.

6.2- Shipping costs belong to the BUYER unless otherwise stated.

6.3- The product must be checked upon delivery; damaged products should not be accepted.

ARTICLE 7 – RIGHT OF WITHDRAWAL

7.1- The BUYER may exercise their right of withdrawal within 14 days from the date of receiving the product.

7.2- Notification of the right of withdrawal must be made via email.

7.3- For food products, the right of withdrawal is subject to the condition that the product packaging is unopened, undamaged, and unused.

7.4- Returned products must be sent complete and in good condition.

ARTICLE 8 – PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE USED

The right of withdrawal cannot be exercised for opened food products, products prepared according to personal needs, and perishable products.

ARTICLE 9 – RESOLUTION OF DISPUTES

The BUYER may submit complaints and objections to the SELLER. In disputes, the Consumer Arbitration Committee or Consumer Courts in the BUYER’s place of residence are authorized.

ARTICLE 10 – AGREEMENT ON EVIDENCE

The SELLER’s records shall constitute evidence in disputes that may arise between the Parties.

ARTICLE 11 – EFFECTIVENESS

This agreement enters into force on the date it is approved electronically by the BUYER.
